Bench of Justices KM Joseph and BV Nagarathna in the Supreme Court on Monday made a query whether pursuing the transfer petition in the case relating to the alleged sexual harassment of a law clerk by former Supreme Court judge Justice Swatanter Kumar, would serve any purpose. The transfer petition was filed by the survivor of alleged sexual harassment, seeking a transfer of the main case from the Delhi High Court to a State where the accused judge had not worked.
The petitioner seems apprehensive that the accused will be able to influence the proceedings if they are held in Delhi, due to his clout in the capital city.
Doesn’t it give a food for thought that this petition is the indicator that Delhi High judgements are compromised? Is the petitioner trying to say that courts are vulnerable to clout? Should the SC not have dismissed such petition out rightly.
